STANDARD TERMS AND CONDITIONS OF SALE
Sale and Transfer
ModVans sells to you and you will purchase from ModVans the described products and services. You agree to pay all taxes and third-party expenses imposed on, in connection with, or measured by the transaction contemplated by this agreement in addition to the prices described.
ModVans assumes no liability for for any products or parts shipped. Title and risk of loss or damage pass to you upon ModVans' delivery of the product or part to the the shipping carrier.
Any stated delivery dates are approximate. ModVans will not be liable for any losses, damages, penalties, or expenses for failure to meet any delivery date.
By completing your order, you accept our terms and conditions.
Fitness of Purpose
ModVans notifies and you acknowledge and agree that products and services are sold without any implied warranties of fitness for a particular purpose.
Warranty
- All products manufactured by ModVans or manufactured to ModVans designs and specifications by ModVans vendors are warrantied against materials or craftmanship defects for one (1) year.
- All 3rd Party products, including Propane Tanks, Furnaces, Air Conditioners, Stoves, Refrigerators, Toilets, Inverters, Awnings, and Stereo Equipment, are warrantied according to their respective manufacturer's warranty terms.
- The Ford Transit Chassis is warrantied by Ford Motor Company according to its terms.
- ModVans warranty service will be provided at the ModVans factory in Sparks, NV.
Before completing your purchase, you should read this Terms and Conditions of Sale in its entirety. If you believe you have a warranty claim, contact our support team at https://www.modvans.com/contact. Please clearly indicate that you are pursuing a warranty claim. For example, an appropriate email subject line would be 'Warranty Claim – ModVans Driver Rear Door Ladder/Tire Carrier Combo." Please be sure to include relevant details, including customer name, order number, description of the issue and pictures or videos. If shipping of a product or part is required to analyze a claim or to exchange a product or part, you will be responsible for all shipping charges to and from our designated facility.
Limited Remedies
Subject to any limitations and exclusions described, and subject to ModVans' determination of warranty eligibility, ModVans may elect in its sole discretion to remedy defects in product materials and/or craftmanship of any product by repairing or replacing the defective product. ModVans may elect in its sole discretion not to repair or replace a defective product and issue you a refund equal to your actual purchase price of the defective product. Repair or replacement of a defective product or a refund will be your exclusive remedy under this warranty. Damage to your vehicle, cargo and/or any other person or property is expressly excluded from the ModVans warranty by these Terms and Conditions.
Returns and Refunds
The cost of return shipping is your responsibility. All warranty claims are decided are at the sole discretion of ModVans.
Some products, due to the nature of their use, are not eligible for returns. This will be clearly stated in the product description. These products are eligible for replacement only. Clearance products are not eligible for returns, refunds or replacement.
When an order is canceled after payment, ModVans is not able recover fees charged for payment processing. To cover these non-recoverable costs, all canceled orders are charged a 5% restocking fee. This fee is non-refundable.
Special order and custom products are not returnable for any refund. Non-special order products that are not defective and eligible for returns can be returned within 15 days of receiving the product. Shipping charges for returned products are your responsibility. Refunds will be based on merchantability. Scratched or damaged products may need repairs. The cost of restoring the product to an acceptable condition is your responsibility and will be deducted from the refund.
Modifications
ModVans products are designed to be mounted to factory equipped vehicles. Aftermarket additions to such vehicle may require modification of a ModVans product. The ModVans warranty does not extend to any products that are modified to fit around other otherwise accommodate or be compatible with any aftermarket vehicle accessories or alterations. ModVans does not guarantee fitment with any other aftermarket accessories or modified vehicle, and it is up to you to determine fitment prior to purchasing any ModVans product.
Damage from Normal Wear and Tear
Damage to ModVans products due to normal wear and tear, including, but not limited to, cosmetic issues and superficial scratches, rust from scratches or abrasion or structural damage to products in connection with vehicle collisions or other structural degradation in connection with the use of such vehicle (on road or off road) will not be covered by the ModVans warranty. Any product user’s misuse, neglect, overloading, improper maintenance or improper installation or repair of any ModVans products are not covered under the ModVans warranty.
Damage from Shipping
Once a product has been picked up by the shipping carrier, it becomes your property. Damage by shipping is not covered by the ModVans warranty. If your product arrives damaged, it is up to the person receiving the package to properly start the shipping damage claims process.
The shipping carrier driver is required to wait for you to inspect the entire shipment. Have the driver stay with you while you inspect your shipment. Do not sign the bill of receipt until the package has been thoroughly inspected and you have determined that there is no damage to the products. If you see any damage to the packaging, take comprehensive pictures of the packaging before opening it to inspect the products. Take more pictures of the damaged products behind the damaged packaging. Ensure that the damage is recorded by the driver on the bill of receipt before signing. Good pictures and having the damage noted on the driver's paperwork at the time of delivery are key to a successful shipping damage claim. Notify ModVans of shipping damage immediately.
Exclusions
- Damage caused by improper use or care of batteries or other products is not covered by this warranty. Please read your owner’s manual before to understand how to install, use and care for the proudct. Email or call ModVans for help if needed.
- Water damage to the inverter is not covered by warranty.
- Damage resulting from not keeping the battery properly charged is not covered by warranty.
- Damage resulting from moving or driving the van without closing and securing the popup top, storage box door or other moving parts completely is not covered by warranty.
- Damage resulting from lifting popup top or using other moving parts when the vehicle is not leveled is not covered by warranty.
- Damage resulting from off-road use is not covered by warranty.
- Damage resulting from rental use is not covered by warranty.
- Damage caused by borrowers not properly trained in the use and safety features of the product is not covered by warranty.
- Damage caused by modifications or additions done anywhere or by anyone other than ModVans is not covered by warranty.
Oversized Tires Disclosure
- Installation of tires larger than the OEM tires installed by the original vehicle manufacturer may/will cause the vehicle's speedometer reading to be inaccurate. ModVans recommends using an app such as Waze for accurate mph readings. There may be no known correction for this issue. ModVans is not liable for any speeding tickets due to inaccurate speedometer readings.
- Inaccurate speedometer readings will result in inaccurate odometer readings, which may reduce the number of miles allowed under the Ford Motor Company Factory warranty. ModVans is not liable for any warranty issues resulting from replacing Ford Factory tires.
- Installation of tires larger than OEM tires installed by the original vehicle manufacturer will raise the center of gravity on a vehicle, which can make the vehicle more likely to roll over and may cause the vehicle to handle differently. ModVans is not liable for any damage, injury, or warranty issues resulting from the installation and/or use of non-OEM tires.
- Due to the Ford factory recall regarding oversized tires, ModVans is not liable for any issues or damages resulting from the installation of larger tires on Ford Transit Trail models.
Lift Kit Disclosure
Installation of a lift kit will raise the center of gravity on a vehicle, which can make the vehicle more likely to roll over and may cause the vehicle to handle differently. ModVans is not liable for any damage, injury, or warranty issues resulting from lift kit installation. Lift kit components need to be inspected on a regular basis.
Off-Road Use Exclusion
Any damage to vehicle or products from off-road use is not covered by the ModVans warranty. ModVans is not liable for any damage, injury, or warranty issues resulting from off-road use.
Rental Exclusion
The ModVans warranty does not cover damages resulting from rental use. ModVans will at its sole discretion determine whether a repair will be covered under warranty for vehicles that are used for rental purposes. Vehicle owners are advised to secure rental deposits and rental insurance.

- Before installing or operating your vehicle or product, please read all applicable owner’s manuals.
- Before installing or operating your vehicle or product, please read the Cautions and Warnings or similar sections of the owner’s manuals to prevent problems and damage.
Agreement to Arbitrate
If you have a concern or dispute, please send a written notice describing it and your desired resolution to contact our support team at https://www.modvans.com/contact. If not resolved within 60 days, you agree that any dispute arising out of or relating to any aspect of the relationship between you and ModVans will not be decided by a judge or jury but instead by a single arbitrator in an arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. This includes claims arising before this Agreement, such as claims related to statements about our products. To learn more about the Rules and how to begin an arbitration, you may call any AAA office or go to www.adr.org. The arbitrator may only resolve disputes between you and ModVans, and claims may not be consolidated without the consent of all parties. The arbitrator cannot hear class or representative claims or requests for relief on behalf of others purchasing or leasing ModVans vehicles. In other words, you and ModVans may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any class or representative action. If a court or arbitrator decides that any part of this agreement to arbitrate cannot be enforced as to a particular claim for relief or remedy, then that claim or remedy (and only that claim or remedy) must be brought in court and any other claims must be arbitrated.
Governing Law and Forum Selection
The governing law of the contract shall be the substantive law of the State of Nevada. The legal place of arbitration shall be the County of Washoe in Sparks, Nevada.
